The Committee considered the Report of the Chief Officer for Highways, Infrastructure Development and Waste (HIW/18/90) on the Annual Local Waiting Restriction Programme which had previously been presented to this Committee on 12 July 2018. 

A significant number of objections and comments had been received since the advertisement of the agreed proposals, details of which were shown in Appendix I to the Report with plans of the proposals shown in Appendix II.

It was MOVED by Councillor Hughes, SECONDED by Councillor Twiss and

RESOLVED

(a)      that work on the annual waiting restrictions programme process for 2019/20 be noted;

(b)      that the recommendations contained in Appendices I and II to Report HIW/18/90) be agreed and the proposals implemented where relevant, subject to:-

          ENV5666/14(A) Frog Lane, Clyst St Mary – that a site visit be arranged and that a decision on the matter be delegated to the Chief Officer for Highways, Infrastructure Development and Waste in consultation with the Local Member and Chair;

(c)      that the proposals detailed in Appendices I and II to Report HIW/18/90) which attracted no objections be implemented as advertised.

(Councillor Sean Wheeldon from the Clyst Honiton Parish Council attended under the Council’s Public Participation Scheme and spoke in support of the proposed recommendations.)

The Committee considered the Report of the Head of Planning, Transportation and Environment and Chief Officer for Highways, Infrastructure Development and Waste (PTE/18/52) which proposed the permanent closure of the road through Clyst Honiton village, as outlined in Appendix I to the Report.

An experimental traffic regulation order prohibiting motor vehicles had been introduced on 9 November 2017 when the roundabout arm to Clyst Honiton was closed off with concrete barriers.  Following the statutory six-month consultation period, the majority of feedback received was in favour of a permanent closure.

Members commended the Clyst Honiton Parish Council and the Council for their joint working on this matter.

It was MOVED by Councillor Bloxham, SECONDED by Councillor Randall-Johnson and

RESOLVED

(a)      that responses to the advertised Traffic Regulation Order be noted;

(b)      that a decision on the modification to the prohibition order be delegated to the Chief Officer for Highways, Infrastructure Development and Waste in consultation with the Local Members and Chair; and

(c)      that authority for approval of minor amendments to the proposed scheme be delegated to the Chief Officer for Highways, Infrastructure Development and Waste.

Electoral Division:  Sidmouth

The Committee considered the Report of the Chief Officer for Highways, Infrastructure Development and Waste (HIW/18/91) outlining the findings of a recent parking consultation undertaken in Sidmouth and parts of Sidford. 

The level of response from the public indicated support for the introduction of residents’ parking restrictions in the vicinity of the town centre, as detailed in Appendix III, and funding for the scheme had been secured.

Members noted that other areas in Devon shared the same parking problems as Sidmouth and, similarly, could be explored at a future meeting of the Committee.

It was MOVED by Councillor Hughes, SECONDED by Councillor Twiss and

RESOLVED

(a)      that the results of the consultation be noted;

(b)      that the advertising of a traffic regulation order to introduce a residents’ parking scheme in areas of Sidmouth as described in Report HIW/19/91), subject to the detailed design being agreed with the local Member, be approved; and

(c)      that a separate consultation exercise be undertaken in the wider Sidford area to better understand the views of all residents.

Electoral Divisions:  Exmouth Brixington & Withycombe and Budleigh

The Committee received the Report of the Head of Planning, Transportation and Environment and the Chief Officer for Highways, Infrastructure Development and Waste (PTE/18/53) which considered the actions in response to a petition received by the Cabinet on 4 October 2017 stating that “We the undersigned request that speed cameras are installed in Hulham Road as soon as possible as a deterrent to speeding vehicles”.

The Council and Devon and Cornwall Police had developed a joint procedure to allow concerns to be assessed in a consistent manner.  This was called the Speed Compliance Action Review Forum (SCARF) which made use of data to ensure assessment of complaints was evidence based.  Since receipt of the petition, speed data had been gathered by both Devon and Cornwall Police and the Council in separate covert operations, at locations agreed with the local Member. 

The Committee heard that any issues relating to this should be reported to local Members for consideration by SCARF.

It was MOVED by Councillor Trail, SECONDED by Councillor Scott and

RESOLVED

(a)      that Hulham Road, Exmouth be considered by the Speed Compliance Action Review Forum (SCARF); and

(b)      that actions arising from the SCARF process be undertaken by the appropriate authority.

(In accordance with Standing Order 23(2) Councillor Bloxham had requested that the Committee consider this matter.)

(Ms P Werhun attended under the Council’s Public Participation Scheme and spoke in support of the proposals.)

The Committee considered the Report of the Local Member which proposed the closure of the two lay-bys located on opposite sides of the B3174 at Cranbrook and that the design of an east/west cycleway to and from Cranbrook/Exeter be brought forward. 

The two lay-bys in question were principally used by HGVs for overnight parking as they provided a free location overnight.  This resulted however in considerable disturbance to adjacent residents and a series of complaints had been received about noise disturbance especially overnight from refrigerated units and engines left running during the early hours.  Instances of anti-social behaviour had also been reported. 

Discussion points with Members and Officers covered:-

·         the cycleway would likely travel along Roman Way and not across the lay-bys;

·         if a traffic regulation order was placed on the lay-bys, it could not be enforced overnight;

·         options for blocking off the lay-bys, e.g. barriers, earth or fencing;

·         how the lay-bys provided a place for HGV drivers to stop for rest breaks;

·         if the A30 suffered a closure, the B3174 provided a diversion route where lay-by facilities would be required; and

·         no funding was available; therefore funding sources would need to be identified.

It was MOVED by Councillor Bloxham, SECONDED by Councillor Twiss and

RESOLVED

(a)      that the two lay-bys located on opposite sides of the highway on the B3174 at Cranbrook (approximately 100m west of Parsons Lane) be closed to vehicle use by some means to be identified by the Chief Officer for Highways, Infrastructure Development and Waste; and

(b)      that the design of the east/west cycleway to operate in parallel with the B3174 be brought forward.
