1 Prayers

Prayers were offered by Father Michael Sharkey, Chaplain of the Commando Training Centre Royal Marines, Lympstone.

2 Election of Chairman

Councillor Croad MOVED and Councillor Radford SECONDED that Councillor Berry be elected Chairman of Devon County Council for the ensuing year.

The Motion was put to the vote and declared CARRIED.

COUNCILLOR BERRY IN THE CHAIR

3 Election of Vice-Chairman

Councillor Hawkins MOVED and Councillor Lee SECONDED that Councillor Pennington be elected Vice-Chairman of Devon County Council for the ensuing year.

The Motion was put to the vote and declared CARRIED.

4 Leader of the Council

Councillor Sir Simon Day MOVED and Councillor S Hughes SECONDED that Councillor Hart be appointed Leader of Devon County Council until the date of the Annual Meeting of the Council in 2013.

The Motion was put to the vote and declared CARRIED.

5 Deputy Leader of the Council

Councillor Hart, the Leader of the Council, MOVED and Councillor S Hughes SECONDED that Councillor Clatworthy be appointed Deputy Leader of Devon County Council for the ensuing year.

The Motion was put to the vote and declared CARRIED.

6 Minutes

The Chairman of the Council MOVED and it was duly seconded that the minutes of the meeting held on 21 May 2009 be signed as a correct record.

The Motion was put to the vote and declared CARRIED.

7 Announcements

The Chairman welcomed new Members to their first meeting of the Council.

The Chairman also reported:

(a) that, in line with previous practice, the Leader of the main Opposition Group, Councillor Greenslade, would be known as the Shadow Leader of the Council, that the Leader of the Labour Party Group was Councillor Mrs Spence and the Leader of the Non-Aligned Group was Councillor Cann;

(b) that, as part of Armed Forces Week, the Lord Lieutenant of Devon and the Chairman had on 22 June 2009 raised the new Armed Forces Day flag at County Hall as a means of showing the Council s appreciation for all those from across Devon who have served or still serve in our armed forces;

(c) reported that Mr D Johnstone, the Executive Director of Adult Community Services, had now left the Council s employ to take up the post of National Director of Operations in the Care Quality Commission, the new independent regulator of health and social care in England, having served the Council with distinction for over 10 years and wished him well for the future;

(d) that Alderman Ken Watson had recently been admitted to hospital and, on behalf of the Council, he would convey his best wishes for a speedy recovery; and

(e) on behalf of the Council, congratulated all those in Devon who had received Honours in Her Majesty the Queen s Birthday Honours List, particularly Ms S Gavin in the Children Young People s Services Directorate who had received the MBE for her work in the adoption service and Councillor Bernard Hughes who had received the OBE for his services to local government.

8 Appointment of Committees

Councillor S Hughes MOVED and Councillor Channon seconded:

"(a) that the Council adopt the Committee structure shown in the Appendix circulated at the meeting with terms of reference set out in the Council s Constitution;

(b) that the Council appoint Committees, Joint Committees and Working Parties/Panels each with the total number of voting members as shown in the Appendix circulated at the meeting for the period expiring at the date of the Annual Meeting of the Council in 2010;

(c) that, as required by section 16(1) of the Local Government and Housing Act 1989, Members be appointed to Committees, Joint Committees and Working Parties/Panels in accordance with the names notified to the Chief Executive by each of the Political Groups represented on the Council, to give effect to the approved allocation of seats as determined at (b) above, as set out for the time being in the Appendix circulated and amended at the meeting;

(d) that the Chief Executive be authorised to approve such changes to membership of the above bodies detailed in the Appendix circulated and amended at the meeting as may be notified from time to time by the political group to which those seats have been allocated by the Council;

(e) that additional Members of Scrutiny Committees, Highways and Traffic Orders Committees, the Standards Committee and the Farms Estate Committee as detailed in the aforementioned Appendix be appointed for the period expiring at the date of the Annual Meeting of the Council in 2013 or as otherwise shown subject to any change notified by the nominating body or, in the case of parent governor representatives on the Children Young People s Scrutiny Committee, following a ballot of eligible parent governors;

(f) that additional Members of Adoption Panels as detailed in the aforementioned Appendix be appointed for the period of office shown and the Chief Executive be authorised to approve such changes as may be notified from time to time by the Executive Member for Children s Health and Wellbeing .

The Motion was put to the vote and declared CARRIED.

9 Chairmen and Vice-Chairmen of Committees

Councillor S Hughes MOVED and Councillor Channon seconded:

"that members shown in the Appendix circulated at the meeting be elected Chairmen and Vice-Chairmen of Committees as indicated therein to hold office until the date of the Annual Meeting of the Council in 2010 .

The Motion was put to the vote and declared CARRIED.

10 Appointment of Cabinet Members

Councillor Hart, the Leader of the Council, MOVED and Councillor Clatworthy seconded:

"that the Council note that the members shown in the Appendix circulated at the meeting have been appointed to the Cabinet and designated as Cabinet Members as indicated therein, to hold office until the date of the Annual Meeting of the Council in 2013 .

The Motion was put to the vote and declared CARRIED.

11 Appointments to Outside Bodies

Councillor S Hughes MOVED and Councillor Channon seconded:

"(a) that members shown in the Appendix circulated at the meeting be appointed to those outside bodies listed to hold office until the date of the Annual Meeting of the Council in 2013 as amended or such other date as indicated therein;

(b) that the Chief Executive be authorised to approve such changes to representation on the above bodies detailed in the Appendix circulated as may be notified from time to time by the political group to which those places have been allocated by the Council .

The Motion was put to the vote and declared CARRIED.

12 Questions from Members of the Council

In accordance with Standing Order 17, the Leader of the Council responded to 8 questions submitted by Members of the Council on Heat Curtains, Members Allowances, Westleigh Junction Highway Scheme, Northern Peninsula Strategic Investment Framework, Ifracombe Sporting Chance Project, Sustainable Communities Act and the new administration s plans.

13 Questions from Members of the Public

In accordance with the Council's Public Participation Rules, the appropriate Leader of the Council responded to a question from a member of the public on Members Allowances.

14 Members Allowances

Councillor Hart, the Leader of the Council, MOVED and Councillor Clatworthy seconded:

"that in compliance with Section 18 of the Local Government and Housing Act 1989 and Regulations made thereunder, the County Council adopt the Scheme of Members Allowances as set out in the Appendix circulated at the meeting to have effect from 25 June 2009 .

15 Notices of Motion: Making Devon Greener

Councillor Hook MOVED and Councillor Greenslade SECONDED that:

Devon County Council has acquired an enviable national reputation as the Greenest County in England and commits to doing all within its power to both maintain and enhance that reputation.

In refreshing the Strategic Plan and taking the Making Devon Greener agenda forward, emphasis be placed on the following;

(i) Introduce measures to cut carbon emissions and promote sustainability at every opportunity;

(ii) To this end DCC will actively promote the fight against mans contribution to Climate Change by ensuring that all new build undertaken by the authority is to the highest BREAM plus standards and is powered predominately by renewable energy power sources and that grey water is harvested and used;

(iii) Triple glazing will be fitted as standard in all new build and wherever appropriate retro fitted. Grants to schools will be made available to encourage this as a priority;

(iv) Communities will be encouraged to grow more food locally. Allotment ownership will be encouraged and garden share schemes promoted. Schools will be encouraged to promote gardening skills as an extra curricular activity;

(v) Fruit trees will be planted wherever possible and practical instead of ornamental species;

(vi) We will seek to decarbonise procurement procedures by working with the Carbon Disclosure Project (CDP). This will enable the authority, amongst other things, to collect data for and comply with its commitments to National Indicator 185;

(vii) The cycleway projects currently being planned will be advanced with alacrity, with particular emphasis being placed on the route from Moretonhampstead to Teignmouth along the Teign Estuary;

(viii) Recycling, already above 60% in some parts of the county, will be 60% across the entire county by 2012. We will seek to be ahead of the national indicators, not following them;

(ix) Consideration will be given to making Devon a Transition County, and in the meantime we will seek to work with existing Transition Town groups and other similar like minded organisations to help promote the shared aims and objectives of such movements and ourselves; and that

(x) The Cabinet Member for the Environment will, in conjunction with the Climate Change Champion, establish an All Party Task Group to consider on a monthly basis policies which will be recommended to the Cabinet to enable DCC to reduce its carbon footprint and promote sustainable living throughout the county.

In accordance with Standing Order 6(6) the Notice of Motion was referred, without discussion, to the Cabinet for consideration.

16 Honorary Aldermen

It was MOVED and it was duly seconded that under Section 249(1) of the Local Government Act 1972, the Council confer on the following past Members of the Devon County Council the title of Honorary Alderman in recognition of their eminent service to the Council during the period of their membership of the Council:
