*PR/45 Minutes

RESOLVED that the minutes of the meeting held on 11 November 2011 be signed as a correct record.

*PR/46 Devon Countryside Access Forum (DCAF)

The Committee received and noted the draft minutes of the meeting of the Devon Countryside Access Forum held on 26 January 2012.

*PR/47 Definitive Map Review 2011/12

(a) Parish of Yealmpton

(Councillor Colthorpe declared a personal interest in the item by virtue of her being a member of the British Horse Society)

The Committee considered the report of the Head of Highways and Traffic Management (HTM/12/6 - text only | pdf HTM/12/6) examining the Definitive Map Review in the Parish of Yealmpton in the District of South Hams, including a Schedule 14 application made by the Trail Riders Fellowship to upgrade Footpath No. 33, Yealmpton to Byway Open to All Traffic status.

It was MOVED by Councillor Sanders, SECONDED by Councillor Bowden and

RESOLVED that no Modification Order be made.

(b) Parish of Woolfardisworthy (Mid Devon)

(Councillor Colthorpe declared both a personal and a prejudicial interest in this item by virtue of respectively her being a member of the British Horse Society and her friendship with local residents, and withdrew from the meeting while the item was considered)

The Committee considered the report of the Head of Highways and Traffic Management (HTM/12/7 - text only | pdf HTM/12/7) examining the routes referred to as Suggestions 4, 5, 6, and 7 arising out of the Definitive Map Review in the Parish of Woolfardisworthy in Mid Devon (the parish also known as Woolfardisworthy East).

It was MOVED by Councillor Sanders, SECONDED by Councillor Knight and

RESOLVED that no Modification Orders be made to:

(i) delete Footpath No. 11, Woolfardisworthy from the definitive map (Suggestion 4) as shown on drawing number HTM/PROW/11/88;

(ii) delete Footpath No. 29, Woolfardisworthy from the definitive map (Suggestion 5) as shown on drawing number HTM/PROW/11/89;

(iii) upgrade Footpath Nos. 6, 7, 8 (part) 10 (part), Woolfardisworthy to a bridleway (Suggestion 6) as shown on drawing number HTM/PROW/11/73;

(iv) upgrade Footpath Nos 13, 16 17, Woolfardisworthy to a bridleway (Suggestion 7) as shown on drawing number HTM/PROW/11/90.

(c) Parish of Abbots Bickington

The Committee considered the report of the Head of Highways and Traffic Management (HTM/12/8 - text only | pdf HTM/12/8) examining the Definitive Map Review in the parish of Abbots Bickington in Torridge District.

It was MOVED by Councillor Knight, SECONDED by Councillor Bowden and

RESOLVED that it be noted that the Definitive Map Review had been completed in the parish of Abbots Bickington and no modifications were required.

(d) Parish of Gulworthy

The Committee considered the report of the Head of Highways and Traffic Management (HTM/12/9 - text only | pdf HTM/12/9) examining the Definitive Map Review in the parish of Gulworthy in West Devon Borough.

It was noted that Councillor Sellis had been consulted as the local County County Councillor rather than Councillor Sanders as shown (Paragraph 3 refers).

It was MOVED by Councillor Knight, SECONDED by Councillor Eastman and

RESOLVED that it be noted that the Definitive Map Review had been completed in the parish of Gulworthy and no modifications were required.

(e) Parish of Hemyock (Part 2)

The Committee considered the report of the Head of Highways and Traffic Management (HTM/12/10 - text only | pdf HTM/12/10) examining the second of three proposals arising from the Definitive Map Review in the parish of Hemyock in the district of Mid Devon.

It was noted that the conclusion in Paragraph 4 should read It is recommended that a Modification Order for a public footpath be made in respect of the Suggestion 2 as shown on drawing no. HMT/PROW/12/07 .

It was MOVED by Councillor Sanders, SECONDED by Councillor Bowden and

RESOLVED that a Modification Order be made to add a public footpath to the Definitive Map and Statement in respect of Suggestion 2 shown on drawing number HTM/PROW/12/07.

(f) Woodbury: Claimed Public Right of Way - Riverfront Road to the Foreshore and Green Lane, Exton

(Mr Halsey attended and spoke under the Council s Public Participation procedure)

The Committee considered the report of the Head of Highways and Traffic Management (HTM/12/11 - text only | pdf HTM/12/11) on whether public rights should be recorded for the route between Riverfront Road to the Foreshore and Green Lane, Exton marked A-B-C-D-E on the plan attached to the report.

A letter from Mr Sharples of 2 Barton Mews, Exton was circulated at the meeting.

It was MOVED by Councillor Sanders, SECONDED by Councillor Knight and

RESOLVED that no Modification Order be made, on the basis of evidence submitted, to record a public right of way from Riverfront Road to Green Lane in Exton, as shown on drawing number HTM/PROW/11/55 between points A-B-C-D-E.

*PR/48 Public Inquiry, Informal Hearing and Written Representation Decisions; Directions and High Court Appeals

(Councillor Colthorpe declared both a personal and a prejudicial interest in this item in relation to the claimed bridleway along Westcott Lane by virtue of respectively her being a member of the British Horse Society and her friendship with local residents, and withdrew from the meeting while the item was considered).

The Committee noted the following decision and direction received from the Secretary of State:

Modification Order: Schedule 14 Application: Claimed Bridleway along Westcott Lane - Parishes of Thelbridge and Washford Pyne - An appeal to the Secretary of State against this Committee s decision not to make an Order in respect of the above claim had been upheld and the County Council had been directed to make the following Order.

It was MOVED by Councillor Sanders, SECONDED by Councillor Knight and

RESOLVED that an Order be made to add a public bridleway along Westcott Lane past Westcott Farm and over the River Dalch (parish boundary) to Bridleway No. 9, Washford Pyne at Wonham Farm between points A - B - C - D as shown on drawing number ED/PROW/09/73.

The Committee noted that the following Modification Orders had been confirmed as unopposed:
