RESOLVED that the minutes of the meeting held on 25 October 2011 be signed as a correct record.

*59 Devon County Council (Road Past Bouchland Farm, Burrington) (Prohibition of Motor Vehicles) Order

Consideration after a Site Visit by the Committee (Minute *48/25 October 2011)

The Committee considered the report of the Head of Highways Traffic Management (HTM/12/20 - text only | pdf HTM/12/20) on the site visit on 9 November 2011 to the R7124 known under the National Street Gazetteer as the Road Past Bouchland Farm and seeking determination of the proposed Traffic Regulation Order for prohibition of motor vehicles from using the R7124.

The report covered, inter alia: the status of the road past Bouchland Farm; visibility distances at the junction with the A377 and options for the future management of the road. It was noted that Burrington Parish Council had been represented at the site visit by Mr P Smale (not Mr K Pincombe as shown).

The following attended and spoke to this item under the Council s Public Participation procedure:

Mr S Bosworth and Mr N Squibb (Trail Riders Fellowship) and Mr P Silvester - objecting to the proposed Order;

Mr B Fraser-Smith (Burrington Parish Council) - supporting the proposed Order.

It was MOVED by Councillor Edgell, SECONDED by Councillor Chugg and

RESOLVED that the Devon County Council (Road Past Bouchland Farm, Burrington) (Prohibition of Motor Vehicles) Order and the gating of the road from Bouchland Farm at its junction with the A377 - as described in Paragraph 3 of Report HTM/12/20 - text only | pdf HTM/12/20 - be approved in the interests of public safety, in view of the sub-standard visibility distances at the junction of the road with the A377.

(In accordance with Standing Order 32(4), Councillors Cann, Davis and Haywood asked that their abstention from voting on this matter be recorded)

*60 Devon and Torbay Local Transport Plan 2011 to 2026: Proposed Programme 2012/13 to 2014/15 for Devon

The Committee considered the joint report of the Head of Planning, Transportation Environment and the Head of Highways Traffic Management (PTE/12/22 - text only | pdf PTE/12/22) summarising the proposed programme for the Local Transport Plan Integrated Transport Block and corporate funding over the next three years in the North Devon area.

The Programme would deliver significant improvements to the transport network in conjunction with other funding sources, contributing to the twin priorities of economic growth and carbon reduction. The total anticipated highway investment in North Devon for 2012/13 was 5,030,000.

The Head of Highways Traffic Management responded to queries and comments from Members on the Programme. He indicated that recent delays in the work on the Bridge Assessment and Strengthening Scheme on the A399 near Brayford had been due to the contractor changing his working methods in view of health and safety considerations.

It was MOVED by Councillor Yabsley, SECONDED by Councillor Chugg and

RESOLVED

(a) that the funding provisions included in Report PTE/11/36 - text only | pdf PTE/11/36 (Devon and Torbay Local Transport Plan 2011 to 2026: Proposed Programme 2012/13 to 2014/15) agreed by Cabinet on 14 December 2011 be noted;

(b) that the Committee be consulted on proposals for the improvement of Junction 27 of the M5 Motorway with the A361 North Devon Relief Road;

(c) that the Head of Planning, Transportation Environment be asked to brief the Committee on the Market and Coastal Towns and Rural Devon Targeted Capital Investment Programme for North Devon.

*61 Progress on One Team Arrangement

(Councillor Haywood declared a prejudicial interest in this item in relation to the discussion on parking by traders in residents parking zones by virtue of being a contractor providing local services and withdrew from the meeting during consideration of the matter)

The Head of Highways Traffic Management gave an update on the One Team highway management arrangement involving virtual joint working with South West Highways which had been introduced on a trial basis in conjunction with the establishment of Neighbourhood Highway Teams and other changes to the service. He commented that: overall the One Team arrangement was working well and that consideration was being given to the procurement of highway management services at the end of the existing contract.

The Committee noted the present position and agreed that the Head of Highways Traffic Management should be asked to discuss capacity issues - especially in relation to the making and implementation of Highway and Traffic Orders - with Committee members.

*62 Roundswell - Re-design Proposals (Minute *56/25 October 2011)

The Head of Highways Traffic Management reported that re-design proposals were now under development.

*63 Residents Parking Orders

In accordance with Standing Order 23(2), Councillor Haywood asked if the determination of Residents Parking Orders to which objections had been received could be expedited. It was noted that Highway and Traffic Orders for residents parking and other schemes under 250,000 where significant objections had been received could be determined by the Head of Highways Traffic Management or the County Solicitor in consultation with the Chairman or Vice-Chairman of the HATOC and the local County Councillor without reference to the HATOC where a decision was urgently required.

*64 Policy on Parking by Traders in Residents Parking Zones

(Councillor Haywood declared a prejudicial interest in this item by virtue of being a contractor providing local services and withdrew from the meeting during consideration of the matter)

In accordance with Standing Order 23(2), Councillor Greenslade spoke on behalf of Councillor Haywood to express his concerns about the arrangements under which traders could park in residents parking zones. The Head of Highways Traffic Management undertook to circulate information on the County Council s Parking Dispensation Scheme (which was under review) to Members.

*65 Update on Roadsigns to Mark Entry to Biosphere Reserve (Minute *54/25 October 2011)

(Councillor Davis declared a personal interest in this item by virtue of representing the Exmoor National Park Authority on the North Devon AONB Partnership)

In accordance with Standing Order 23(2), Councillor Cann expressed the view that North Devon s Biosphere Reserve should be more widely promoted.

It was MOVED by Councillor Cann, SECONDED by Councillor Fowler and

RESOLVED that the recommendation by the Biosphere Reserve Partnership for the installation of Biosphere Reserve Gateway signs on the major roads entering the North Devon UNESCO World Biosphere Reserve as a means of promoting this unique asset be commended to the Cabinet.

*66 Actions Taken Under Delegated Powers

The Committee received and noted the report of the Head of Highways Traffic Management (HTM/12/21 - text only | pdf HTM/12/21) detailing the actions taken under delegated powers since the last meeting and, where appropriate, in consultation with the Chairman and local members.
