*PR/35 Minutes

RESOLVED that the minutes of the meeting held on 14 November 2014 be signed as a correct record.

*PR/36 Devon Countryside Access Forum

The Committee received the draft minutes of the meeting held on 20 January 2015.

It was MOVED by Councillor Knight, SECONDED by Councillor Sanders and

RESOLVED that the evidence collection exercise being undertaken by the Devon Countryside Access Forum around the interpretation of Dog Control Orders across the county be supported.

*PR/37 Review of Definitive Map Statement Priorities

The Committee received the report of the Head of Highways, Capital Development Waste (HCW/15/12 - text only | pdf HCW/15/12) outlining the current Definitive Map Statement of Priorities and recommending policy change to take account of reduced staff resources with the Definitive Map Team and to ensure that the Statement was clear, robust and achievable.

It was MOVED by Councillor Knight, SECONDED by Councillor Gilbert and

RESOLVED that the Definitive Map Review Policy Statements DM1A and DM1C/2 be amended as outlined in the Report and that Policies DM1B/2 and DM1D remain unchanged.

*PR/38 Definitive Map Reviews

Parish Reviews

(a) Parish of Bere Ferrers

The Committee considered the report of the Head of Highways, Capital Development and Waste (HCW/15/13 - text only | pdf HCW/15/13) and background papers available prior to and at the meeting,

examining five proposals arising from the Definitive Map Review in the parish of Bere Ferrers.

Councillor Sanders as the local County Councillor reported that he was not aware of any objections to the proposals from local residents or the parish council.

It was MOVED by Councillor Hook, SECONDED by Councillor Knight and

RESOLVED

(i) that Modification Orders be made to modify the Definitive Map and Statement by:

(A) adding a public footpath between points W - X as shown on drawing number HCW/PROW/14/69 (Proposal 10) to resolve an anomaly affecting Footpath No. 63 so that it meets the county road;

(B) deleting part of Footpath No. 7, between points N O, and Well Lane being added to the List of Streets as a county road between points M O as shown on drawing HCW/PROW/14/67 (Proposal 6), to resolve an anomaly affecting the footpath so that it meets the county road;

(ii) that a Modification Order not be made in respect of Proposal 8, but that the county road Y1901, Lockridge Road be extended on the List of Streets between points S T (Proposal 8);

(iii) that Modification Orders not be made in respect of Proposals 1 and 3.

(b) Parish of Pancrasweek

The Committee considered the report of the Head of Highways, Capital Development and Waste (HCW/15/14 - text only | pdf HCW/15/14) examining the Definitive Map Review in the parish of Pancrasweek in Torridge.

It was MOVED by Councillor Gilbert, SECONDED by Councillor Knight and

RESOLVED that the completion of the Definitive Map Review in the parish of Pancrasweek with no requirement for modifications, be noted.

(c) Parish of Ivybridge

(Councillor Croad attended in accordance with Standing Order 25(2) and spoke to this item in relation to Proposal 2).

(Ms J Shearn attended the meeting under the Council s Public Participation Scheme and spoke to this item in relation to Proposal 2, objecting to the proposed Modification Order).

The Committee considered the report of the Head of Highways, Capital Development and Waste (HCW/15/15 - text only | pdf HCW/15/15) and background papers available prior to and at the meeting,

examining two proposals arising from the Definitive Map Review in the parish of Ivybridge, in the South Hams.

It was MOVED by Councillor Sanders, SECONDED by Councillor Knight and

RESOLVED

(i) that a Modification Order be made to modify the Definitive Map and Statement by adding a public footpath between Footpath No.3, Ivybridge and the publicly maintainable footways to Trehill and Ash Grove Ivybridge, points D E shown on drawing number HWC/PROW/15/ 153a (Proposal 1);

(ii) that a Modification Order not be made in respect of the claimed addition of a footpath from Bridge Park to Sandy Lane and Exeter Road, Ivybridge shown on drawing number HCW/PROW/15/153 (Proposal 2).

(d) Parish of Chawleigh (Part 3)

(Councillor Squires attended in accordance with Standing Order 25(2) and spoke to this item).

(The Committee also acknowledged representations made on behalf of Mr Webber in relation to Proposal 4, objecting to the proposed Modification Order, who was not present at that time).

The Committee considered the report of the Head of Highways, Capital Development and Waste (HCW/15/16 - text only | pdf HCW/15/16) and background papers available prior to and at the meeting, examining the remaining two proposals arising from the Definitive Map Review in the parish of Chawleigh.

It was MOVED by Councillor Colthorpe, SECONDED by Councillor Hook and

RESOLVED

(i) that a Modification Order be made to modify the Definitive Statement by deleting the section describing the route of Footpath No. 12, Chawleigh between points A B C D - E as shown on drawing number HCW/PROW/14/20a (Proposal 3);

(ii) that a Modification Order be made to modify the Definitive Map by adding the section of Footpath No 14, Chawleigh between points A B and C - D - E - F as shown on drawing number HCW/PROW/14/21a (Proposal 4).

*PR/39 Modification Orders

The Committee noted that the following Modification Orders had been confirmed as unopposed:

(a) Footpath No. 4a, Sandford Definitive Map Modification Order 2014;

(b) Restricted Byway No. 52, Sandford No. 47, Copplestone Definitive Map Modification Order 2014;

(c) Bridleway No. 53, Sandford No. 7, Upton Hellions Definitive Map Modification Order 2014.

*PR/40 Public Path Orders

Diversion Orders

The Committee noted that the following Public Path Orders had been made and confirmed under delegated powers:

(a) Footpath No. 79, Axminster Public Path Diversion and Definitive Map and Statement Modification Order 2014;

(b) Footpath No. 5, Clyst St Lawrence Public Path Diversion and Definitive Map and Statement Modification Order 2014;

(c) Footpath Nos. 15, West Anstey 27 Molland Public Path Diversion and Definitive Map and Statement Modification Order 2014;

(d) Footpath No. 3, Powderham Public Path Diversion and Definitive Map and Statement Modification Order 2013.
