*PR/64 Minutes

RESOLVED that the minutes of the meeting held on 16 November 2012 be signed as a correct record.

*PR/65 Public Rights of Way Manager

The Chairman reported the impending retirement of Mr Mike Jenkins after a long and distinguished career in local government and public rights of way where he achieved national recognition. On behalf of the Committee he wished Mr Jenkins a long and happy retirement.

The Chairman also reported that Mrs Ros Mills had been appointed as the new Public Rights of Way Manager. The Committee congratulated Mrs Mills on her appointment.

*PR/66 Devon Countryside Access Forum (DCAF)

The Committee received the draft minutes of the meeting of the Devon Countryside Access Forum held on 8 February 2013.

*PR/67 Definitive Map Reviews: Parish Reviews

(a) Definitive Map Review: Parish of Cheriton Fitzpaine

(Councillor Colthorpe declared a personal interest in this matter by virtue of her relationship with friends and acquaintances in the area who had made representations in this matter)

The Committee considered the report of the Head of Highways and Traffic Management (HTM/13/11 - text only | pdf HTM/13/11) on routes referred to as Suggestions 1 and 2 arising out of the Definitive Map Review in the Parish of Cheriton Fitzpaine in Mid Devon.

It was MOVED by Councillor Sanders, SECONDED by Councillor Knight and

RESOLVED that Modification Orders be made to:

(i) modify the Definitive Map and Statement to add a continuation to Footpath No. 6, Cheriton Fitzpaine between points A and E so that the path connects to the county road (A3072) as shown on drawing number HTM/PROW/12/77 (Suggestion 1);

(ii) modify the Definitive Map and Statement to add a continuation to Footpath No. 14, Cheriton Fitzpaine between points A and C so that the path connects to the county road at Coleman's as shown on drawing number HTM/PROW/12/78a (Suggestion 2).

(b) Definitive Map Review 2011-13: Parish of Tavistock

The Committee considered the report of the Head of Highways and Traffic Management (HTM/13/12 - text only | pdf HTM/13/12) on a Definitive Map Review in the parish of Tavistock in the West Devon District.

It was MOVED by Councillor Sanders, SECONDED by Councillor Eastman and

RESOLVED that it be noted that the Definitive Map Review had been completed in the parish of Tavistock and no modifications are required.

(c) Definitive Map Review: Parish of Hemyock (part 3)

(Mrs Bickerton attended the meeting under the Council s Public Participation Scheme and spoke to this item against the proposed Order)

The Committee considered the report of the Head of Highways and Traffic Management (HTM/13/13 - text only | pdf HTM/13/13) on a proposal arising from the Definitive Map Review in the Parish of Hemyock in the District of Mid Devon.

It was MOVED by Councillor Sanders, SECONDED by Councillor Colthorpe and

RESOLVED that a Modification Order be made to add a public footpath to the Definitive Map and Statement in respect of Suggestion 3 shown on drawing number HTM/PROW/13/3.

(d) Definitive Map Review 2011-13: Parish of Combe Martin Part 1

The Committee considered the report of the Head of Highways and Traffic Management (HTM/13/14 - text only | pdf HTM/13/14) initial proposals arising out of the Definitive Map Review in the parish of Combe Martin in North Devon District. The Chairman reported the support of the local member for the proposal.

It was MOVED by Councillor Sanders, SECONDED by Councillor Eastman and

RESOLVED that a Modification Order be made to upgrade Footpath No. 13, Combe Martin to a bridleway as shown on drawing number HTM/PROW/13/6.

(e) Definitive Map Review 1989- 94: Parish of Teignmouth

The Committee considered the report of the Head of Highways and Traffic Management (HTM/13/15 - text only | pdf HTM/13/15) on six proposals arising from the Definitive Map Review in the Parish of Teignmouth in the District of Teignbridge.

It was MOVED by Councillor Sanders, SECONDED by Councillor Knight and

RESOLVED that Modification Orders be made to record the routes of Proposals 1 - 6 detailed in Appendix I and shown on drawing nos. ED/PROW/94/113-115 hereto as public footpaths.

*PR/68 Public Inquiry, Informal Hearing and Written Representation Decisions; Directions and High Court Appeals

The Committee noted the following decisions and directions which had been received from the Secretary of State:

(a) Modification Orders

(i) Schedule 14 Application: Deletion of Footpaths No. 8 Northleigh, No. 3 Farway, No. 6 Colyton and No. 10 Southleigh: the appeal to the Secretary of State against this Committee s decision in November 2011 not to make an Order in respect of the above application had been re-determined and the appeal again had been dismissed by the Planning Inspectorate.

(ii) Written Representations: Kenn Footpath No. 17, Definitive Map Statement Modification Order 2011 confirmed subject to modification to upgrade to bridleway;

(iii) Public Inquiry: Frithelstock Restricted Byway No. 14, Definitive Map Statement Modification Order 2010 confirmed;

(iv) Written Representations: Honiton: Footpath Nos. 26 10, Definitive Map Statement Modification Order 2011 - confirmed subject to modifications of specified widths.

(b) Public Path Orders

(i) Informal Hearing: Woolfardisworthy Footpath Nos. 7, 8, 9 10, Public Path Diversion Order 2010 confirmed with modifications;

(ii) Written Representations: Wembworthy Foopath No. 12 and Bridleway No. 13 Public Path Diversion Definitive Map Statement Modification Order 2011 confirmed with modifications.

*PR/69 Public Path Orders Diversion Orders

(a) Proposed Diversion: Footpath No. 2, Kings Nympton

(Mr Kenyon attended the meeting under the Council s Public Participation Scheme and spoke against the proposed Order and Mr Steer Fowler also attended and spoke in support of the proposed Order)

(Councillor Edgell attended in accordance with Standing Order 25(2) and spoke to this item).

The Committee considered the report of the Head of Highways and Traffic Management (HTM/13/16 - text only | pdf HTM/13/16) on an application by landowners to divert a public footpath in the parish of Kings Nympton to divert Footpath No. 2, Kings Nympton from the line A B to the line A C B as shown on drawing no. HTM/PROW/11/83B.

It was MOVED by Councillor Knight, SECONDED by Councillor Eastman and

RESOLVED that the Committee visit the site and invitations be sent to the local County Council member, applicant and objectors representatives and the application be considered at a future meeting.

(b) Proposed Diversion: Bridleway No. 44, Shaugh Prior

The Committee considered the report of the Head of Highways and Traffic Management (HTM/13/17 - text only | pdf HTM/13/17) on an application by Sibelco UK to divert a public bridleway in the parish of Shaugh Prior to enable permitted development to take place.

It was MOVED by Councillor Sanders, SECONDED by Councillor Eastman and

RESOLVED that a Public Path Diversion Order be made under Section 257 of the Town and Country Planning Act 1990 to divert Footpath No. 44, Shaugh Prior from the line A B to the line A C D E F as shown on drawing no. HTM/PROW/12/114 and that if there are no objections, or if such objections are made and subsequently withdrawn, it be confirmed as an unopposed order.
