Exclusion of the Press and Public

Recommendation: that the press and public be excluded from the meeting for the following items of business under Section 100(A)(4) of the Local Government Act 1972 on the grounds that they involve the likely disclosure of exempt information as defined in Paragraph 3 of Schedule 12A of the Act namely, financial and business affairs of the Council and third parties, and in accordance with Section 36 of the Freedom of Information Act 2000, by virtue of the fact that the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

RESOLVED that the press and public be excluded from the meeting for the

Cullompton Town Centre Relief Road Funding Agreement

(An item taken in accordance with paragraph 8 of the Cabinet Procedure Rules and the Local Authorities (Executive Arrangements) (Meetings and Access to Information) (England) Regulations 2012 with the consent of the relevant Scrutiny Committee Chair under Section 100A(4) of the Local Government Act 1972).

 

 

The Cabinet considered the Report of the Report of the Director of Climate Change, Environment and Transport (CET/25/02) regarding the funding agreement for the Cullompton Town Centre Relief Road following the decision taken by Cabinet in December.

 

The Report and Impact Assessment for the scheme and also the minutes from the December meeting could be viewed at - Cabinet 11th December 2024.

 

The Cabinet noted that the December Cabinet Report had stated the authority would not input any capital monies into the Project and that the arrangements for sharing any risk associated with any overspend would be laid out in the funding agreement. It was now proposed that such risk be shared between the two authorities, and this change therefore required Cabinet approval.

 

The matter having been debated and the options and alternatives and other relevant factors (e.g. financial, sustainability and carbon impact, risk management, equality and legal considerations and alignment with the Council’s Strategic Plan) set out in the Director’s Report having been considered:

 

it was MOVED by Councillor Davis, SECONDED by Councillor McInnes, and

 

RESOLVED

 

(a) that the acquisition of land through negotiation and/or compulsory purchase order (CPO) be approved, together with any necessary associated side roads orders that may be required for the scheme;

 

(b) that delegated authority be given to the Director of Climate Change, Environment and Transport, in consultation with the Director of Legal and Democratic services, Director of Finance and Public Value and the Cabinet Member for Climate Change, Environment and Transport, to agree the final wording and implementation of the funding agreement; and

 

(c) that the inclusion of a financial risk sharing clause as set out in the Report in the funding agreement for the Cullompton Town Centre Relief Road with Mid Devon District Council be agreed.
