The Committee considered the report of the Head of Planning, Transportation and Environment (PTE/16/37) on a summary of the outcomes of the examination hearings for the Devon Minerals Plan and sought approval for consultation on main and additional modifications. The Head of Service confirmed that members’ views could be submitted as part of the consultation process.

 

It was MOVED by Councillor Brook, SECONDED by Councillor Bowden and

 

RESOLVED that consultation be undertaken on the proposed main and additional modifications to the Devon Minerals Plan provided in Appendices II and III of Report PTE/16/37) subject to endorsement by the Cabinet Member for Economy, Growth and Cabinet Liaison for Exeter.

(Ms Ferguson and Mr Penny (for the applicant) attended under the Council’s Public Participation Scheme and spoke respectively against and in support of the application).

 

The Committee considered the report of the Head of Planning, Transportation and Environment (PTE/16/38) on an application to amend conditions specifying the source of material to be imported to the existing processing plant, at Blackhill Quarry for the remainder of the life of the current permission which expires in December 2016. 

 

The Head of Service’s Report gave a reasoned assessment of the proposal, referring to all relevant policies and summarising the comments and views of interested parties received prior to the meeting.

 

The matter having been debated and having also had regard to the main material planning policies and requirements

 

It was MOVED by Councillor Brook, SECONDED by Councillor Bowden and 

 

RESOLVED that planning permission be granted in accordance with the conditions set out in Appendix II to Report (PTE/16/38) and the variations to the Section 106 agreement as set out in Appendix III to this report with any subsequent changes to the conditions or legal agreement be agreed in consultation with the Chairman and local County Councillor.

 

(N.B. In line with the Council’s Development Management protocol Councillor Dezart was precluded from voting on the application not having been present throughout the debate thereon)

Highway Consultation: Exeter City: Outline planning application for up to 123 houses and associated infrastructure, with all matters reserved except for access at Land adjoining the West of England School, Topsham Road, Exeter

(Councillor Leadbetter attended in accordance with Standing Order 25(2) and spoke to this item requesting that objections be raised by the Council as the Highway Authority)

 

The Committee considered the report of the Strategic Director, Place (SPL/16/1) on the County Council’s (as Local Highway Authority) proposed response to an outline planning application to the Exeter City Council to build up to 123 houses on land to the north of The West of England School and College for children and young people with little or no sight. The application included two points of vehicular access.  One would be utilising the existing School ghost island right turn junction on Topsham Road and the other would connect to Wendover Way, an existing residential street in the Tollards/Southbrook estate that provided an additional access to Topsham Road via the Tollards Road signalised junction.

 

The Report gave a reasoned assessment of the non-car transport issues, the vehicular impact of the proposals and vehicular and pedestrian/cycle accessibility. The Director reported further on objections received by County Council (as the Highway Authority) since publication of the report.

 

Councillor Hannaford proposed, with the support of Councillor Dewhirst, that the Highway Authority oppose this application by reason of safety, congestion and amenity of local residents; but subsequently the proposal was withdrawn on the advice of the County Solicitor due to the lack of evidence, as indicated by the Director, to support the reasons put forward at any Inquiry.

 

The matter having been debated and having also had regard to planning policy considerations, the impact on the highway network as a result of the proposals and mitigation measures secured

 

It was subsequently MOVED by Councillor Brook, SECONDED by Councillor Bowden:  

 

(a) that Exeter City Council be advised that Devon County Council as Local Highway Authority, raises no objections to the application subject to the Applicant entering into an appropriate Legal Agreement and imposition of planning conditions as set out in Section 4 of Report SPL/16/1;

 

  (b) that the detailed wording of any legal agreement and planning conditions be delegated to    the Strategic Director – Place.

 

The Motion was put to the vote and declared LOST.  

 

Thereafter and in light of the proposed response by the Highway Authority not having been approved

 

It was then MOVED by Councillor Brook, SECONDED by Councillor Sanders and

 

RESOLVED that Exeter City Council be advised that the Committee is not able to submit any view on this application.

 

(NB In accordance with Standing Orders Councillor Morse requested that her abstention from voting be recorded)
