(Councillors Bowden and Wragg each declared a personal interest in this matter by virtue of their being members of East Devon District Council).

 

The Committee considered the report of the Head of Planning, Transportation and Environment (PTE/16/31) on a retrospective planning application to store and process plasterboard as an additional waste stream to waste wood and UPVC at Greendale Barton, an industrial estate to the east of Exeter.

 

The Head of Service’s Report gave a reasoned assessment of the proposal, referring to all relevant policies and summarising the comments and views of interested parties received prior to the meeting. He also suggested an additional condition  relating to the manner of operation and location of the low speed shredder to help protect the amenity of the area in terms of noise pollution.

 

The matter having been debated and having also had regard to the main material planning policies and requirements

 

It was MOVED by Councillor Sanders, SECONDED by Councillor Dewhirst and

 

RESOLVED

 

(a) that planning permission be granted in accordance with the planning conditions set out in Appendix II to Report PTE/16/31 with additional planning conditions relating to:

 

(i) the use of the Low Speed Shredder;

 

(ii) shredding of plasterboard being carried out within the processing building;

 

(ii)  details of the method of covering of plasterboard stored outside to be submitted to the Waste Planning Authorty;

 

with any subsequent changes to the planning conditions being agreed in consultation with the Chairman and local County Councillor.

 

(b) that the County Council explore with the applicant, the resumption of a Community Liaison Group relating to the Business Park.

 

(NB: In line with the Council’s Development Management protocol Councillor Eastman was precluded from voting on the application not having been present throughout the debate thereon)

(Mr Toms and Mr Garside (for the applicant) attended under the Council’s Public Participation Scheme and spoke respectively against and in support of the application)

 

The Committee considered the Report of the Head of Planning, Transportation and Environment (PTE/16/32) on an application for the removal of Condition 8 (Hours of Use) and variation of Condition 9 (Limit on Storage) of planning permission 14/00172/FULL for construction of slurry/septic tank sludge pit at Old Tellam’s Yard, Cheriton Bishop.

 

The Head of Service’s Report gave a reasoned assessment of the proposal, referring to all relevant policies and summarising the comments and views of interested parties received prior to the meeting. The Head of Service also reported objections from Hittisleigh Parish Council and Cheriton Bishop Parish Council relating to the impacts on the local road network and loss of amenity for local residents arising from the application.

 

The matter having been debated and having also had regard to the main material planning policies and requirements.

 

It was MOVED by Councillor Bowden SECONDED by Councillor Sanders and

 

RESOLVED

 

(a) that permission for the removal of Condition 8 (Hours of Use) be approved subject to an alteration of condition 4 (as set out in Appendix II to Report PTE/16/32) relating to timing of deliveries to the site;

 

(b) that permission for the variation of Condition 9 (Limit on Storage) be refused for the reason that the increase in vehicle traffic would have an adverse impact on the peaceful enjoyment of the countryside and of the individual residences.

(Councillor Greenslade attended in accordance with Standing Order 25(2) and spoke to this item in relation to the need for additional contributions from the developer, should no objections be raised).

 

(Councillors Yabsley and Greenslade both declared personal interests in this matter by virtue respectively of their membership of North Devon District Council and by being a member of the Devon & Somerset Fire and Rescue Authority and a family member being a serving police officer).

 

The Committee considered the Report of the Head of Planning, Transportation and Environment (PTE/16/33) on the County Council’s (as Highway Authority) response on a full planning application for the erection of up to 43 dwellings on land west of Youings Drive, Barnstaple. The local County Councillor suggested that assurances be sought from the developer for additional contributions (S.106) relating to highways drainage, improved public service bus provision/stop and towards a Park & Ride Scheme to mitigate the effects of the proposal in terms of the impact on the local highway network. 

 

The Head of Service’s Report gave a reasoned assessment of the non-car transport issues, the vehicular impact of the proposals.

 

The matter having been debated and having also had regard to the impact on the highway network as a result of the proposals and mitigation measures secured

 

It was MOVED by Councillor Brook SECONDED by Councillor Sanders and

 

RESOLVED that North Devon Council be advised that Devon County Council, as Highway Authority raise no objection to the application subject to the signing of a Section 106 agreement relating to a financial contribution towards highway infrastructure and enhancements to bus services as set out in Appendix I report and planning conditions as set out in Appendix II to Report PT/16/33.
